These Terms of Use ("Agreement") govern the rights and obligations between AGENTA GROUP YAZILIM TURİZM TİCARET LİMİTED ŞİRKETİ ("Camperello", "Company", "Platform") and all users ("User") utilizing the website camperello.com and its associated mobile applications (collectively referred to as "Platform"). All Users visiting, registering, or benefiting from the services of the Platform declare and undertake that they have read, understood, and accepted the content of this Agreement. Users who do not accept this Agreement must refrain from using the Platform.

1. Parties and Service Provider Information

The User may benefit from the Platform in the capacity of "Seller" (selling equipment or publishing a caravan listing) or "Buyer" (purchasing equipment). This Agreement has been prepared in accordance with the provisions of the Turkish Code of Obligations No. 6098, the Law No. 6502 on the Protection of Consumers, the Law No. 6563 on the Regulation of Electronic Commerce, the Law No. 5651 on the Regulation of Publications Made on the Internet and the Fight Against Crimes Committed by These Publications, and the Law No. 6698 on the Protection of Personal Data.

2. Definitions

Platform: refers to the website camperello.com and its mobile applications. Intermediary Service Provider: refers to the natural or legal person providing an electronic commerce environment for the economic and commercial activities of others, as defined in Article 2/(d) of Law No. 6563 on the Regulation of Electronic Commerce. Camperello operates as an intermediary service provider in the equipment sales and caravan classified listing services offered on the Platform. Seller: refers to the natural (C2C) or legal (B2C) person offering equipment for sale or publishing caravan listings on the Platform. Buyer: refers to the person purchasing equipment or browsing caravan listings through the Platform. Content: refers to all types of text, visuals, videos, listings, comments, and data published on the Platform.

3. Scope of the Platform's Activities and Intermediary Nature

Camperello offers two main services: (a) Equipment sales marketplace: Individual (C2C) and corporate (B2C) Sellers offer equipment for sale. Camperello collects the sale price, deducts a 15% service commission and the payment provider's commission, and then transfers the remaining amount to the Seller. (b) Caravan listing: Sellers publish caravan listings for a fee; the buyer and seller communicate directly. In this service, the sale price does not pass through the Platform. IMPORTANT NOTE: Camperello does not operate as a travel agency within the meaning of Law No. 1618 on Travel Agencies and the Union of Travel Agencies. The Platform merely provides technical intermediation between property owners and guests, and between sellers and buyers, as an information society/intermediary service provider under Law No. 6563. Camperello is not a party to the equipment sales contracts; the contract is established directly between the Seller and the Buyer. Caravan sales take place outside the Platform.

4. Membership and Account Obligations

To register on the Platform, one must be at least 18 years of age and possess legal capacity. Individuals under the age of 18 may only register with the consent of their legal guardians. The User declares that the information provided during registration is accurate, current, and complete. The User is obliged to update this information immediately in the event of any changes. The User is solely responsible for the security of their account and password. All transactions conducted through the account shall be deemed to have been made by the User. In the event of suspicious access, the User must immediately notify support@camperello.com. As a rule, a User may only open one account. Camperello reserves the right to suspend or terminate accounts in cases of misuse, false information, or violation of this Agreement.

5. General User Obligations

The User undertakes to use the Platform only in accordance with the law, morality, public order, and this Agreement. The User agrees not to share any content that violates the provisions of the Turkish Penal Code No. 5237, Law No. 5651, Law No. 6698 (GDPR), and other legislative provisions. Insult, threats, discrimination, hate speech, obscene content, personal data disclosure, copyright infringement, and false information are strictly prohibited. The User shall not engage in any actions that may harm the Platform's infrastructure, such as automated data scraping, reverse engineering, unauthorized access, or DDoS attacks. The User may not use another person's identity, payment instrument, or account without permission.

7. Seller Obligations (Equipment and Caravan Listing)

The Seller guarantees that they own the property of the product offered for sale, that there are no third-party rights on the product, and that its import or sale is not prohibited. Corporate Sellers (B2C) are subject to consumer law as "sellers" under Law No. 6502 on the Protection of Consumers and the Distance Selling Agreement Regulation. Individual Sellers (C2C) are not considered sellers under consumer law; however, Camperello contractually applies a 14-day right of withdrawal and return in favor of consumers. The Seller is obliged to carry out the shipping processes personally. Camperello provides the infrastructure for contracted shipping (Aras Kargo), but the shipping and delivery operations are the responsibility of the Seller. The Seller is obliged to send the invoice or e-archive invoice, which they are required to prepare under Law No. 213 on Tax Procedure, to the Buyer along with the product. The Seller listing a caravan shall guarantee that the product is available for sale during the listing period and that they will remove the listing when it is sold. The obligation for notarized sales under Law No. 2918 on Road Traffic lies with the Seller and Buyer.

8. Content Policy and Liability of Intermediary Service Provider

The responsibility for all Content published on the Platform, including listings, visuals, descriptions, and comments, lies with the respective User. Camperello, as an intermediary service provider under Article 9 of Law No. 6563 (as amended by Law No. 7416), is obliged to remove content that is reported to be unlawful within a reasonable time frame. Camperello is not under an obligation to proactively monitor content; however, when made aware of unlawful content, it will take necessary action in accordance with Law No. 5651 and Law No. 6698 (GDPR). The User declares that they own the copyright of the content uploaded to the Platform or have obtained the necessary permissions. The User grants the Platform a non-exclusive, free license to use, reproduce, and publish this content for the purpose of providing the service, limited to the duration and purpose of the service, under Law No. 5846 on Intellectual and Artistic Works. Reports of unlawful content may be made to support@camperello.com.

9. Intellectual and Industrial Property Rights

The design, software, interface, logo, "Camperello" brand, and all components of the Platform are the property of the Company under Law No. 5846 on Intellectual and Artistic Works, Law No. 6769 on Industrial Property, and relevant legislation. The User may not copy, reproduce, create derivative works, or use these elements for commercial purposes without the Company's explicit written consent.

10. Payment, Commission, and Entitlement

Equipment payments and caravan listing fees made through the Platform are collected via the 3D Secure infrastructure of PayTR payment providers. For equipment sales, Camperello applies a 15% service commission. These commissions are in addition to the transaction fees charged by the payment providers. Payments to the Seller are contingent upon the completion of delivery, the expiration of the withdrawal period, and the absence of disputes. The fee for listing a caravan advertisement is collected at the moment the advertisement is published; there is no right of withdrawal as the performance has commenced under Article 15/1-(h) of the Distance Selling Agreement Regulation.

11. Cancellation, Return, and Right of Withdrawal

The conditions for withdrawal and return are regulated under a separate heading titled "Cancellation and Return Conditions". In summary: • For equipment purchases, there is a right of withdrawal without justification for 14 days in accordance with Article 48 of Law No. 6502 and the Distance Selling Agreement Regulation. • Since performance of the caravan listing service begins when the listing is published, the right of withdrawal does not apply to caravan listing fees pursuant to Article 15/1-(h) of the Distance Contracts Regulation.

12. Limitation of Liability

Camperello, as an intermediary service provider, is not primarily responsible for defects in the products sent by the Seller, shipping delays, misleading information in caravan listings, or disputes between users. The primary responsibility in these matters lies with the respective Seller. Camperello cannot be held liable for service interruptions that may occur due to force majeure, errors in third-party infrastructure (hosting, payment providers, internet service providers) to which the Platform is connected, cyber attacks, or user-induced errors. This provision preserves the mandatory liability provisions introduced by Law No. 6502, Article 115 of the Turkish Code of Obligations No. 6098, and Law No. 6563.

13. Force Majeure

Events arising outside the control of the parties and which cannot be prevented by reasonable measures, such as war, terrorism, natural disasters, epidemics, fire, flood, earthquake, strike, lockout, decisions of official authorities, internet infrastructure outages, and similar circumstances shall be considered as force majeure. During the force majeure period, the obligations of the parties shall be suspended.

14. Amendments to the Agreement

Camperello reserves the right to unilaterally amend this Agreement. Changes shall take effect on the date they are published on the Platform; substantial changes will be communicated to the User via email or in-platform notification. Continuing to use the Platform after changes signifies acceptance of the new Agreement.

15. Termination of the Agreement

The User may terminate their membership at any time through their account settings. A User with an open order or unresolved dispute may not terminate their membership until the relevant transactions are completed. Camperello may suspend or terminate the User's account without prior notice in the event that the User violates this Agreement, applicable law, or third-party rights. In such cases, the User may be held liable for any resulting damages.

16. Protection of Personal Data

The personal data of the User is processed in accordance with Law No. 6698 on the Protection of Personal Data and relevant secondary legislation. Detailed information is available on the "GDPR Privacy Notice" and "Privacy Policy" pages.

17. Resolution of Disputes and Competent Court

Users with the status of consumers may apply to the District/Provincial Consumer Arbitration Committee or the Consumer Court of the place of residence or where the consumer transaction was conducted, in accordance with the annual monetary limits updated by the Ministry of Commerce under Law No. 6502 on the Protection of Consumers. For the year 2026, the jurisdictional limit of the consumer arbitration committee is the amount announced by the Ministry of Commerce; Consumer Courts are competent for disputes exceeding this amount. Turkish law shall apply to disputes arising from this Agreement. For disputes not related to consumer transactions, the Courts and Enforcement Offices of Kuşadası (Aydın) shall have exclusive jurisdiction. It is essential to resolve disputes primarily through amicable means, and inquiries may be directed to support@camperello.com.

18. Other Provisions

The invalidity of any provision of this Agreement shall not affect the validity of the other provisions. Rights arising from the Agreement may not be assigned to third parties without the written consent of the other party. Camperello may assign its rights and obligations to its affiliates or successors. Notifications between the parties shall be validly made through the email address registered in the User's account or via support@camperello.com.
